Terms of Service

Four Legs Media LLC

These Terms of Service ("Terms") govern your access to and use of the website, newsletter, premium subscriptions, and related services (collectively, the "Services") operated by Four Legs Media LLC ("Company," "we," "us," or "our"), doing business as The Underbite.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 16 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of Services

The Underbite is a business-to-business media publication serving the pet industry. Our Services include a free email newsletter, a website featuring editorial content and industry analysis, premium subscription access with additional content and features, and press release distribution (both free and paid). The specific features and availability of the Services may change at our discretion.

3. Accounts and Subscriptions

Free Newsletter Subscription

You may subscribe to our free newsletter by providing your email address. You may unsubscribe at any time by clicking the "unsubscribe" link in any email.

Premium Subscriptions

Premium subscriptions are available for purchase through our platform via Beehiiv. Upon purchasing a premium subscription, a passwordless account will be created for you through Memberstack to access premium content.

  • Billing. Premium subscription fees are billed on a recurring basis as described at the time of purchase. All payments are processed by Stripe.
  • Cancellation. You may cancel your premium subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds will be issued for partial billing periods unless otherwise required by applicable law.
  • Price changes. We reserve the right to change subscription pricing at any time. We will provide reasonable advance notice of any price increase. Continued use of the premium Services after a price change takes effect constitutes your acceptance of the new pricing.
Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@theunderbite.co if you become aware of any unauthorized use of your account.

4. Intellectual Property

Our Content

All content published through the Services — including articles, newsletters, analysis, reports, graphics, logos, trademarks, and other materials — is the property of Four Legs Media LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit our content without our prior written consent, except as follows:

  • You may share links to our content.
  • You may quote brief excerpts of our content for commentary, criticism, or news reporting purposes, provided you include appropriate attribution to The Underbite.
Trademarks

"The Underbite," "Four Legs Media," and associated logos and marks are trademarks of Four Legs Media LLC. You may not use our trademarks without our prior written permission.

5. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any portion of the Services, other accounts, or systems connected to the Services.
  • Use automated tools, bots, scrapers, or similar technology to access the Services or extract content without our prior written consent.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Transmit viruses, malware, or other harmful code through the Services.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Services to send unsolicited communications, spam, or promotional materials.
  • Circumvent, disable, or otherwise interfere with any security or access control features of the Services.

6. Press Release Submissions

Submission of press releases through the Services is governed by these Terms and by our separate Press Release Policy, which is incorporated herein by reference. In the event of a conflict between these Terms and the Press Release Policy with respect to press release submissions, the Press Release Policy shall control.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content published through the Services, including industry analysis, market data, product reviews, or any other editorial content.

THE CONTENT PUBLISHED THROUGH THE SERVICES IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL, LEGAL, FINANCIAL, OR INVESTMENT ADVICE. YOU SHOULD CONSULT QUALIFIED PROFESSIONALS BEFORE MAKING BUSINESS DECISIONS BASED ON INFORMATION OBTAINED THROUGH THE SERVICES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOUR LEGS MEDIA LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless Four Legs Media LLC, its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit through the Services, including press releases.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law).

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction and venue of such courts.

12. Modifications

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the revised Terms on our website and updating the "Last Updated" date above. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Press Release Policy, constitute the entire agreement between you and Four Legs Media LLC regarding the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
